1. Agreement to Terms

By accessing or using Horizon AI Solutions Pty Ltd's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

Horizon AI Solutions provides artificial intelligence and machine learning services including but not limited to: custom AI development, predictive analytics, computer vision solutions, MLOps infrastructure, and AI chatbot platforms.

3. Account Registration

To use our services, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Be responsible for all activities under your account

4. Acceptable Use

You agree NOT to:

  • Use our services for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe on intellectual property rights
  • Transmit malicious code or viruses
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer or decompile our software
  • Use our services to harm others or create discriminatory AI models

5. Intellectual Property

All content, software, and technology provided by Horizon AI Solutions remain our exclusive property. Custom AI models developed for your specific use case will be licensed to you according to your service agreement. You retain ownership of your input data.

6. Data Usage and Privacy

Your data will be handled in accordance with our Privacy Policy and Australian privacy laws. We use your data solely to provide services, improve our AI models (with consent), and as required by law.

7. Payment Terms

  • All fees are in Australian Dollars (AUD) unless otherwise specified
  • Payment is due according to your service agreement (monthly, annually, or project-based)
  • Late payments may incur a 5% monthly fee
  • We accept credit cards, bank transfers, and purchase orders for enterprise clients
  • Refunds are provided according to our refund policy (within 30 days of service commencement)

8. Service Level Agreement (SLA)

For enterprise clients, we guarantee:

  • 99.9% uptime for cloud-hosted services
  • 24/7 technical support
  • Response time: Critical issues within 2 hours, standard issues within 24 hours
  • Monthly performance reports

9. Limitation of Liability

To the maximum extent permitted by Australian law, Horizon AI Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Warranties and Disclaimers

Our services are provided "as is" without warranties of any kind. While we strive for accuracy, AI models may produce errors. You are responsible for validating AI outputs before business use.

11. Termination

Either party may terminate services with 30 days written notice. We reserve the right to immediately suspend or terminate accounts that violate these Terms. Upon termination, you must cease using our services and we will provide your data in a standard format within 14 days.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be resolved in the courts of Australia.

14. Indemnification

You agree to indemnify and hold harmless Horizon AI Solutions from any claims arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

15. Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, or internet service disruptions.
